Please review the arbitration agreement set forth below in Section 2, as it will require you to resolve disputes with Plight Hero on an individual basis through final and binding arbitration. By entering this agreement, you agree and acknowledge that you have read and understand all the terms of this agreement and have taken time to consider the consequences of this important decision. 

2. Arbitration Agreement:

By agreeing to the terms and condition of Plight Hero courier service, you agree that you are required to resolve any claims that you may have against Plight Hero on an individual basis in arbitration, as set forth in this Arbitration Agreement between you and Plight Hero and not in a court of law. You acknowledge and agree that you and Plight Hero are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. This will disqualify you from bringing any class, collective, or representative action against Plight Hero, and also prohibit you from participating in or recovering relief under any current or future class, collective, consolidated, or representative action brought against Plight Hero by someone else.

3. Use of Mobile App:

PLIGHT HERO provides a mobile application (“App”) to facilitate the booking, tracking, and management of courier services. By downloading, installing, or using the App, you agree to comply with the terms and conditions set forth in this agreement.

a. License to Use the App
PLIGHT HERO grants you a limited, non-exclusive, non-transferable license to download, install, and use the App on your mobile device solely for personal or business purposes in accordance with these Terms and Conditions. This license does not grant you any ownership rights in the App or any related intellectual property.

b. App Features and Functionality
The App enables users to:

  • Schedule Deliveries: Request same-day, urgent deliveries and track their status in real-time.
  • Manage Account: View delivery history, update contact information, and manage payment methods.
  • Notifications: Receive updates on delivery status, estimated delivery times, and other relevant notifications.
  • Payment Processing: Complete payments for services through the App using accepted payment methods.

We reserve the right to modify, enhance, or discontinue any features of the App at our discretion, without prior notice.

c. Restrictions on Use
You agree not to:

  • Use the App for any unlawful, fraudulent, or unauthorized purposes.
  • Reverse engineer, decompile, or attempt to derive the source code of the App.
  • Interfere with or disrupt the functionality of the App, including using software or devices that may cause the App to behave abnormally.
  • Use the App to engage in any activity that harms, disrupts, or interferes with the rights or property of others, including other users or PLIGHT HERO.

d. App Updates and Maintenance
PLIGHT HERO may update the App periodically to improve functionality, fix bugs, or enhance user experience. Updates may include security patches, new features, or modifications. You agree to promptly install any such updates and understand that certain features may not function correctly without the latest version of the App.

e. App Availability
While PLIGHT HERO strives to ensure the App is available at all times, there may be periods of downtime or interruptions due to maintenance, updates, technical issues, or other factors beyond our control. PLIGHT HERO is not liable for any temporary or permanent unavailability of the App.

f. Account Responsibility
By using the App, you agree to provide accurate, current, and complete information when registering and using the services. You are responsible for safeguarding your account login credentials and ensuring that only authorized users access your account. You must promptly notify PLIGHT HERO of any unauthorized use or suspected security breaches.

4. Eligibility

a. Legal Capacity
Our platform is intended for use only by individuals who can form legally binding agreements under applicable law. By accessing or using our services, you represent and warrant that you are at least 18 years old or the age of majority in your jurisdiction, whichever is greater, and that you have the full right, authority, and capacity to enter into this agreement and comply with its terms.

b. Compliance with Laws
You agree that your use of the platform complies with all applicable local, state, national, and international laws and regulations. Additionally, you confirm that you are not located in, a resident of, or a citizen of a country subject to U.S. government sanctions or embargoes.

c. Account Accuracy and Responsibility
You must provide truthful, accurate, and complete information when registering an account or using the platform. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

d. Restrictions on Use
You may not use our platform if you have been previously prohibited or banned from doing so by us. Organizations or entities may not use the platform unless represented by an individual with the proper legal authority to bind the entity to this agreement.

e. Warranty of Eligibility
By accessing or using the platform, you warrant that you meet all of these eligibility requirements. If you do not meet these requirements, you must not access or use the platform.

f. Right to Verify and Enforce
We reserve the right to verify your eligibility at any time. If we determine that you have violated this agreement or do not meet the eligibility criteria, we may suspend or terminate your access to the platform without notice.

5. Service Description

PLIGHT HERO specializes in providing professional courier services, focusing on urgent, same-day deliveries tailored to meet the needs of both individuals and businesses. Our services include the safe and efficient transport of small parcels, medical supplies, legal documents, and other time-sensitive items, ensuring that deliveries are completed with reliability, precision, and speed.

We operate with a commitment to excellence, offering flexible delivery solutions designed to adapt to the unique requirements of our clients. While we strive to provide uninterrupted services, all offerings are subject to availability, as factors such as demand, operational constraints, and unforeseen circumstances may affect service fulfillment.

PLIGHT HERO reserves the right to modify, suspend, or terminate services at any time and without prior notice to maintain operational integrity or comply with legal, regulatory, or logistical needs. Additionally, certain restrictions may apply to the types of items eligible for delivery, and we reserve the right to refuse service for prohibited or improperly packaged goods.

By using our services, you acknowledge and accept that delivery timelines are estimates and may vary due to external factors such as traffic, weather conditions, or other unavoidable delays. We are committed to minimizing disruptions and providing timely communication to our clients whenever possible.

6. Prohibited Items

For safety, legal, and operational reasons, Plight Hero will not pick up, transport, or deliver the following unauthorized items:

  • Hazardous Materials: Includes but is not limited to explosives, flammable liquids, radioactive materials, and other dangerous goods.
  • Weapons and Firearms: Any type of firearm, ammunition, or weapon.
  • Illegal Substances: Includes drugs, narcotics, and any other substances prohibited by law.
  • Perishable Goods: Items that require refrigeration or have a limited shelf life, such as fresh food or flowers.
  • Biological Specimens: Includes human or animal remains, organs, and other biohazards.
  • Counterfeit Goods: Any items that are fake or replicated without authorization.

Customer Responsibilities:

Customers are responsible for ensuring that the items they send comply with our terms and conditions. If unauthorized items are found in the shipment, Plight Hero reserves the right to refuse the delivery and may report the incident to the appropriate authorities.

Liability:

Plight Hero is not liable for any damages, losses, or legal consequences arising from the transportation of unauthorized items. Customers will be held responsible for any damages or losses incurred because of sending prohibited items.

Packaging and Labeling Requirements:

Customers are responsible for ensuring that their packages are properly packed and labeled. This includes using suitable materials to protect the contents and clearly marking the destination address and any special handling instructions. Plight Hero is not liable for any damage caused by inadequate packaging.

Pickup and Delivery

  • Pickup: Customers must ensure that the items are ready for pickup at the agreed-upon time and location. Any delays or additional costs resulting from the customer’s failure to have items ready will be the customer’s responsibility.
  • Delivery: Plight Hero will make every effort to deliver items within the estimated delivery time. However, we are not liable for delays caused by circumstances beyond our control, such as traffic, weather conditions, or other unforeseen events.    

7. Payment And Refund

All services must be paid for in accordance with the rates and payment terms agreed upon at the time of booking. Plight Hero reserves the right to require payment in advance for our services.

Payment Methods
We accept the following payment methods on our Site:

  • Credit Card and Debit
  • PayPal

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Cancellations and Refunds

  • Cancellations: Customers may cancel their orders prior to pickup without penalty. Cancellations made after pickup may incur charges.
  • Refunds:

    Refunds for services provided by PLIGHT HERO are considered on a case-by-case basis and are offered at the sole discretion of the company. We understand that there may be situations where a refund is requested due to delivery issues, cancellations, or other exceptional circumstances. However, refunds will only be granted when it is determined that PLIGHT HERO is at fault or if services were not provided in accordance with our terms.

    a. Conditions for Refunds
    Refund requests will be reviewed based on the following conditions:

    • Service Failure: If the delivery was not completed as agreed, including but not limited to late delivery or undelivered items, a refund may be considered.
    • Cancelled Deliveries: If a delivery is canceled before pickup or during transit and the cancellation was due to a mistake or oversight by PLIGHT HERO, we may offer a refund. In a situation where the  customer cancel the order while in transit, the customer is responsible to pay full price of the delivery and a refund will not be granted by Plight Hero.
    • Billing Errors: Refunds may be granted in cases where billing errors occurred due to technical issues or mischarges that were not the fault of the customer.

    b. Refund Process
    To request a refund, customers must contact PLIGHT HERO customer service within 10 days of the delivery date. All refund requests must include relevant details of the delivery, including tracking numbers, order information, and any supporting documentation. PLIGHT HERO will review the request and respond within a reasonable time frame.

    c. No Service Fee for Refunds
    PLIGHT HERO does not charge any service fees for processing refunds. If a refund is granted, the full amount paid for the delivery, excluding any third-party service fees (e.g., payment processor charges), will be refunded to the original payment method used for the transaction.

    d. Exceptions and Limitations
    Refunds may not be granted in the following situations:

    • The service was completed as agreed, and no fault is found with the delivery.
    • The refund request is made after the 10 days period from the delivery date.
    • The customer failed to comply with delivery requirements or provided inaccurate information that affected the delivery.

    e. Right to Modify Refund Policy
    PLIGHT HERO reserves the right to modify or discontinue its refund policy at any time, without prior notice, in order to reflect changes in our services or operational requirements.

8. Limitation of Liability

  • Plight Hero’s liability for any loss or damage to the items being transported is limited to the declared value of the goods or the maximum liability amount of $500.00, whichever is lower.
  • Plight Hero is not liable for any indirect, incidental, or consequential damages, including loss of profits or business interruptions, arising from the use of our services.

9. User Accounts:
To use certain features of our website, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

10. Orders and Deliveries:

When you place an order through our website, mobile app, or any other designated platform, you are making an offer to purchase our delivery services under the terms and conditions of this agreement. By submitting an order, you acknowledge and agree to the following:

a. Placing an Order
Orders for delivery services can be placed via our website, mobile application, or any other platform we may designate from time to time. When you place an order, you are required to provide accurate, complete, and current information, including but not limited to the recipient’s name, address, phone number, and any other relevant delivery details. It is your responsibility to ensure that the information you provide is correct, as any errors or omissions may impact the delivery process.

b. Acceptance or Rejection of Orders
All orders placed through our platform are subject to review and approval by PLIGHT HERO. We reserve the right, at our sole discretion, to accept, reject, or modify any order, whether due to availability of services, incorrect information provided, payment issues, or any other reason. An order is only considered accepted and binding once you receive a confirmation from us, either via email, mobile notification, or through the platform.

c. Delivery Times and Estimates
The estimated delivery times provided at the time of placing an order are based on our best judgment and are subject to change due to factors outside our control, including but not limited to weather conditions, traffic delays, or unforeseen circumstances. While we strive to meet or exceed the estimated delivery times, we cannot guarantee that deliveries will be completed within the specified time frame.

d. Changes and Cancellations
Once an order is placed, you may request changes or cancellations; however, requests will be subject to our ability to accommodate such modifications before the delivery process has begun. If a cancellation request is made after the delivery has started, no refund may be issued, and you will be responsible for the payment of the services rendered up until that point.

e. Responsibility for Accuracy
You agree to provide accurate and up-to-date delivery details and understand that any failure to do so may result in delays, additional charges, or the inability to complete the delivery. PLIGHT HERO is not responsible for issues arising from incorrect or incomplete information provided by you.

11. Fees:
Delivery charges may apply to each delivery order, and such charges will be clearly displayed at the time of order placement. Charges will include applicable taxes where required by law. Charges may include other applicable fees such as delivery fees, service fees, product return fees, cancellation fees, estimated or actual tolls. Further, Charges applicable in certain geographical areas may increase during times of high demand or due to other marketplace factors. Additional fees may apply for special delivery requests or services. Payment is due at the time of order placement unless otherwise specified. We accept payment through credit card, and debit card.

12. Subscription

Automatic Renewal
Your subscription automatically renews, and you will be automatically billed until we receive notification that you wish to cancel the subscription.

Canceling  Your Subscription
To cancel your subscription, please follow these steps: Customers can cancel their subscription by contacting our customer support team at subscription@plighthero.com or directly on our website.

Deadline for Cancellation
To avoid being charged for the next billing cycle, subscription cancellations must be requested at least five (5) business days before the renewal date.

Refund 
Refunds will be issued on a prorated basis for the unused portion of the subscription term upon cancellation. Refunds will be processed within five (5) to seven (7) business days of the cancellation request.

Communication
Customers will receive a confirmation email once their subscription cancellation request is processed. A confirmation page will also be displayed on the website for added transparency.

Effects of Cancellation
Upon cancellation, customers will retain access to subscription benefits until the end of the current billing cycle. Access will be revoked after the current subscription period ends.

13. Intellectual Property:

All content, trademarks, logos, designs, images, text, videos, and other intellectual property displayed or available through our website, mobile application, or any other platforms (“Intellectual Property”) are the exclusive property of PLIGHT HERO or its licensors, and are protected by applicable copyright, trademark, and other intellectual property laws.

a. Ownership of Intellectual Property
You acknowledge and agree that PLIGHT HERO, or its licensors, owns all rights, titles, and interests in and to the Intellectual Property, and no rights are granted to you except as explicitly stated in this agreement. The content available on our website or platform is for your personal or business use in connection with our services and may not be used for any other purpose without prior written consent from PLIGHT HERO.

b. Restrictions on Use
You may not use, reproduce, modify, distribute, display, publish, transmit, or create derivative works based on any of PLIGHT HERO’s Intellectual Property, including without limitation the content on our website, without obtaining prior written approval from PLIGHT HERO. Any unauthorized use of the Intellectual Property constitutes a violation of PLIGHT HERO’s intellectual property rights and may result in legal action.

c. Trademarks
The PLIGHT HERO name, logo, and all other trademarks, service marks, and trade names used on our website or mobile application are trademarks or registered trademarks of PLIGHT HERO or its licensors. You may not use any of these trademarks without prior written consent from PLIGHT HERO, except for purposes that comply with the authorized usage outlined by PLIGHT HERO.

d. Licenses and Permissions
Any express permission for use of our Intellectual Property will be granted in writing by PLIGHT HERO, and such permission may be subject to specific terms and conditions as set forth by us. Unauthorized use of our intellectual property may result in the immediate termination of your access to our services and may lead to legal consequences.

14. Limitation of Liability:

To the fullest extent permitted by applicable law, PLIGHT HERO, its affiliates, officers, directors, employees, agents, or licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any other damages of any kind, arising out of or in any way related to the use of our website, mobile application, or delivery services, even if PLIGHT HERO has been advised of the possibility of such damages.

This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, or any other tangible or intangible losses resulting from:

  • The use or inability to use our services, website, or mobile application;
  • The performance, or non-performance, of delivery services, including delays or failures in delivery;
  • Errors, omissions, interruptions, or other inaccuracies on our platform or in our services;
  • Unauthorized access to or use of your account or data, including third-party interference with our systems;
  • Any other matter relating to the services provided or the website itself.

In no event shall PLIGHT HERO’s total liability to you for any claims arising from this agreement or your use of our website or services exceed the total amount paid by you to PLIGHT HERO for the specific service giving rise to the claim.

You agree that the limitations of liability and disclaimers set forth in this agreement are essential elements of the bargain between you and PLIGHT HERO. Without these limitations, PLIGHT HERO would not be able to provide the services to you.

Indemnification:

You agree to indemnify, defend, and hold harmless PLIGHT HERO, its affiliates, officers, directors, employees, agents, licensors, and successors (collectively, “Indemnified Parties”) from and against any and all claims, demands, actions, lawsuits, losses, damages, liabilities, costs, or expenses (including but not limited to attorneys’ fees, court costs, and expert fees) that arise out of or in any way related to:

  1. Your Use of Our Website and Services: Any use of our website, mobile application, or delivery services, whether authorized or unauthorized, including any data or content you transmit, submit, or share via these platforms.

  2. Violation of Terms and Conditions: Any breach of these Terms and Conditions, including but not limited to your failure to comply with the obligations set forth herein, or your violation of any laws, regulations, or third-party rights in connection with your use of our services.

  3. Infringement of Third-Party Rights: Any claim that your actions (such as submitting content, providing inaccurate delivery instructions, or interfering with PLIGHT HERO’s systems) infringe or misappropriate the intellectual property or other rights of any third party.

  4. Conduct or Actions: Any unlawful, negligent, or reckless conduct on your part, including actions that cause harm to PLIGHT HERO, its affiliates, or other users of our services.

You further agree that you will cooperate in the defense of any such claims, and that PLIGHT HERO reserves the right to assume exclusive control over the defense and settlement of any matter that is subject to indemnification under this section. You shall not settle any such claim without the prior written consent of PLIGHT HERO.

This indemnity obligation will survive the termination of your use of our services and the expiration or termination of these Terms and Conditions.

Governing Law:
These terms and conditions shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.
Changes to Terms: We reserve the right to update or modify these terms and conditions at any time without prior notice. Your continued use of our website after any changes indicates your acceptance of the revised terms.
